A Research On The Intellectual Property Protection Of Software User Interface

This thesis is continuing the research of the intellectual property protection for the software user interface,which bases on the study of many seniors.That is a new intellectual property question in China,and there is a huge controversy no matter in theory or practice.Part1is exordium,in the beginning,the thesis introduces several domestic cases about software user interface,then leads to the questions of which is the legal attributes of software user interface and what protection should be for it. And then it is literature review.In the last,it explains why does only the argument of the copyright protection and the design patent protection.Part2is the introduction of the user interface including the definition,the characteristics and the difference with the program of user interface.Part3is the introduction of foreign countries protection for user interface. Including: USA,EU,Japan and Korea.Part4,the thesis analyses whether the user interface possesses the originality, whether the idea and expression mix together.Then the thesis introduces what legal barriers are in the design patent protection for user interface in China and the causes.Part5,the author thinks the user interface can be doubly protected by copyright and design patent,but it should be limited with the standard of network economic effect.
