In the tide of global economic integration and the social modernization, traditionalculture is confronted with unprecedented impact, particularly, the intangible culturalheritage is at the risk of extinction. Manchu intangible cultural heritage can not beexcepted under such condition. The legal protection of Manchu intangible culturalheritage has special meaning to the diversity of our national culture. But in the face ofthe present urgent circumstances, a lack of sound legal protection makes it a groomyprospect. Therefore, exploring a legal system to protect Manchu intangible culturalheritage is particularly important. This paper is going to raise the people’s awareness ofand lead them to discuss Manchu intangible cultural heritage with a reference to a casestudy. The whole paper falls into five parts.The first part mainly introduces the concept of intangible cultural heritage and theresearch scope of intangible cultural heritage. There are many kinds of each nation’sintangible cultural heritage, and Manchu intangible cultural heritage has itscharacteristics which are different from other nation’s.The second part mainly introduces the justification of protecting manchu intangiblecultural heritage. First, it discribes the danger manchu intangible cultural heritagefacing.Then, it states the importance of protecting Manchu intangible cultural heritageby law from the following aspects: the urgency of protecting Manchu intangible culturalheritage, the adherence to the diversity of culture, the country’s need of social harmony,the adaptation to the requirements of the International Cultural Protection Organization,etc. Finally, it introduces the significance of protecting Manchu intangible culturalheritage from the construction needs and obligations of promoting law and the rigidmethod.The third part introduces the existing legal dilemma in protecting Manchu intangiblecultural heritage in our country. It states the existing specific difficulties and problemsof protecting Manchu intangible cultural heritage mainly from the departments of civillaw, administrative law, intellectual property law, criminal law, international law,etc.The fourth part mainly introduces the domestic legislation for the protection ofnational intangible cultural heritage in the United States, India, Brazil and othercountries. The author summarizes the foreign countries’ legislative experience andpractice of protecting national intangible cultural heritage, hoping that their experience and practice guide the protection legislation in our country.The fifth part is mainly the construction of legal system for protecting Manchuintangible cultural heritage in our country. Having reviewed characteristics of manchuintangible cultural heritage and the importance and legal meaning of protecting Manchuintangible cultural heritage, we get to know the major dangers and kinds of legaldifficulties in protecting it. We can build our country’s sound legal system to protect ourManchu intangible cultural heritage refering to the findings of.foreign countries’slegislative experience and practice in protecting their intangible cultural heritage.
