Legalization Of Protecting Intangible Cultural Heritage Under The View Of Modernization Of The National Governance

In November 2013, the Communist Party of China’s eighteen committee of third plenary session passed the Decision of the Central Committee of the Communist Party of China on Some Major Issues Concerning Comprehensively Deepening the Reform, put forward the dea that the overall goal of deepening the reform comprehensively is to improve and develop socialism with Chinese characteristics, and to promote the modernization of the national governance system and capacity. Modern national governance covers economic, political, cultural, social, ecological and other aspects, and the modernization of cultural governance is an important part. In the process of achieving the modernization of the national cultural governance, Intangible Cultural Heritage’s Protection has been more emphasis on the country, and it has become an important part of our cultural construction. Intangible cultural heritage is the traditional culture of a country and nation which has been transmitted from generation to generation, and it plays a crucial role in the traditional culture. In the long history of Chinese traditional culture, there are a lot of intangible cultural heritages. Protecting our intangible cultural heritage is not only beneficial to inherit and carry forward the Chinese traditional culture, but also benefits for building socialist advanced culture, for achieving the grate development and flourishing of culture. In this paper, I have explored the protection of our intangible cultural heritage under the view of modernization of the national governance, including introducing the relation by modernization of the national governance and the legalization of protection of our intangible cultural heritage, analyzing the problems in the legalization of protection of our intangible cultural heritage, put forward some constructive comments about the legalization of protection of intangible cultural heritage.In this paper, the text is divided into three parts:the first part mainly introduces the agreement between modernization of the national governance and legalization of protection of our intangible cultural heritage. Including modernization of the national governance’s connotation, features, the basic ways, and legalization is the only way to modernize national governance, and protection of intangible cultural heritage. The second part mainly introduces the problems we are faced with in the process of protecting intangible cultural heritage. Such as government, companies, educational institutions, individual, their protection ideology is not enough, and our legal system is not perfect, and the protection working mechanisms and methods are imperfect. Third part mainly introduces the ways about protection of intangible cultural heritage under the view of modernization of the national governance. The basic ways including establishing the correct legal protection ideology of intangible cultural heritage, strengthening legislation and improving the legal system, promoting law-based administration in an all-round way, and the scientific protection methods.
