Water is one of the key factors for the improvement of national comprehensive national strength, and it is one of the important controlling factors of the ecological environment construction. Now water is facing the danger of drying up due to the transition of human for natural resources development and utilization. Therefore, it is a major issue that we need to study,that how we can enable water to continue to use for humans under the premise not to destroy the ecological balance of the development.As a developing country, in the era of planned economy, We see the water as a priceless inexhaustible resources to content development and utilization, to cause the serious water pollution and waste water, our water conditions are worrying. The scarcity of water resources has become an important factor restricting for China’s economic development, combined with the current our country administrative command and engineering measures adopted by the water-saving management model, seeking economic maximization but ignoring the needs of ecological and natural, all kinds of disharmonious incongruous factors have emerged, and shortage of water resources are more and more serious. We must use legal way to seek effective ways to solve this problem. At present,the establishment of the legal system of water saving can fundamentally inefficient use of water resources methods to realize the effective and reasonable allocation of water resources, improve the utilization of water resources in our country.Because China’s water resources is shortage,so saving water resources is of great significance to our country:first of all,it is an essential requirement to solve the water crisis in China at present, in the second it is the inevitable requirement of water-saving society, in the third it is the inevitable requirement of sustainable development society. The establishment of the water saving system can fundamentally solve the shortage of water resources of our country. At present, the water saving system has many problems, such as, system does not form a complete set, the legal system guarantee does not reach the designated position, water resources property rights can be evaded, water right transfer mechanism is insound, water price system is inscientific,public participation in the institutional channels is lack and so on. The United States, Japan, Israel, the three water saving system is the successful example of the water saving system, their use of water efficiency is higher than our country, and they has rich experience on water saving system. Compared with other studies, we get the inspiration:we should put water on an important position in economic life, attache great importance on the use of water to regulate reasonably use water resources, attache great importance to establish an effective water conservation management system, attach importance to the construction of water-saving system of laws and regulations. We should constantly perfect the system of water saving in our country through the above analysis.Legally speaking, we should perfect construction of laws and regulations of water saving in our country, set up special "The act of saving water" and make the planning of the national utilization of water "; In addition, we also should constantly improve the legal system related to water saving, such as, we should build system of water saving funds, establish a reasonable system of water price, set up the mechanism of right transfer of water, etc. And,we should need to confirm the legal responsibility at the same time and establish the mechanism of public participation.
