Studies On The Localization Of The Predial Servitude

Accompany with the development of economy and society, the relation betweensupply and demand of land in China has been more and more strained. The types ofusing lands are diversified and the focus changes from ownership to utilization. Theapplication of the Predial Servitude emerges as the time requires. This thesis aims tocomb the origin, development and evolution of the Predial Servitude from acomparative perspective and to introduce the rules of Civil Law legal system andCommon law legal system; and to analyze the localized elements on legal, social,economic aspects of the Predial Servitude in China. The emphasis is mainly on theexploration to localize the Predial Servitude in China and to forecast the trend oflocalization in the future by presenting appropriate programs.
