Studies On Predial Servitude

The promulgation of the law of property right in China concludes the predial servitude as a type of unaided usufructuary right. However, how the predial servitude undependently exists? What is the material relationship between servitude and others types of property rights? There're more to discuss. Especially, the abstract studies on theories of whether the system value of predial servitude can freely establish usufructary right obligate space for parties concered in the principal of legality of real right are obviously not enough. Actually predial servitude provides a common right mode of setting up usufruct on real estate for the convenience of new utilization becoming property right. Combining legislation overseas and the development of eaesment of the world today, the author makes comments on the law system of real right of China in this article, hoping that it will be helpful for the perfection of the the law of property right in future.
