Using Social theory to research law is a critical and helpful way to get a deepunderstanding of it. French sociologist Pierre Bourdieu (August1930–January2002)analyzes juriducal field using his original concepts such as field、habit、capital and symbolicpower,giving a special answer of the questions “what is law” and” the legitimacy of law”which are crucial to law.Bourdieu’s contribution to Jurisprudence should be valued.This aritical has four parts besides the introduction and conclusion.Part1is to describe why Pierre Bourdieu draws out his theory of juriducalfield.Analytical Jurisprudence thinks that law is rules and regulations,while SocialJurisprudence sees the law as a kind of practice.Bourdieu puts forward the opinion that thelaw should be understood through juriducal field.The law is produced and pratises in thejuriducal field. Bourdieu’s theory of juriducal field is built on the concepts of field、habit、capital and symbolic power.Part2analyzes the structure and practice of juriducal field.Juriducal field is the socicaluniverse in which the law is produced and pratises.It has the special logic of itself,theautonomy of juriducal field is the basis of the independence of law.The actors in the juriducalfield have different kinds of capital,and compat with each other,promoting the changes ofjuriducal field.Part3studies the law in juriducal field.In modern society,the law is a kind of symbolicpower.The basis of reality of the law as symbolic power is in the consistency with socialpower structure. And the universalization and neutralization assure the legality of law.Part4is commentary to juriducal field.Bourdieu’s theory of juriducal field is theapplication of his social theory.He thinks the law should be understood though juriducal field.The conclusion summarizes the outline of this article.The theory of juriducal fieldanswers the questions of “what is law” and” the legitimacy of law”with a short space andspecial analysis tools.The research methods of Bourdieu are also very special,such asdistinction of practice logic and theory logic、relationalism and reflection attitude,giving usmuch revrelation.
