The emergence of the Internet has changed the traditional trading methods and promotedthe diversification of trading patterns. As a new type of e-business models, networkgroup-purchasing brings people with its rapid, convenient shopping experience. It not onlyexacerbated the unequal status between consumers and operators, but also made theemergence of a series of drawbacks against the interests of consumers. Low barriers to entry,lack of industry standards about group-purchasing site; operator’s lack of good faith, falsepropaganda; government regulatory gaps in the system, lack of relevant legislation, whichimpeded the industry’s healthy development of China’s network group-purchasing. With theincreasing number of Internet users and even younger consumer groups in China, networkgroup-purchasing industry in China has much room for development and potential. Therefore,the regulation about network group-purchasing industry becomes an urgent problem now.This article is to solve the problems on network group-purchasing industry in China in theperspective of economic law.The article has four parts in addition to the introduction and conclusion:The first part is the “Network Group-purchasing Outline”, which is divided into fivesections. Firstly, this section explains the concept of network group-purchasing and makepeople know that it is the combination of modern network economy and group-purchasing.Then explain the concept of group-purchasing and summarize the final definition of networkgroup-purchasing in the perspective of economy and law. Secondly, it describes threecommercial network group-purchasing models, and analyzes the pros and cons of the threemodels to clarify the scope discussed in this paper is limited to the third business model; andthen summarizes the characteristics and the reasons for the emergence and development ofnetwork group-purchasing; Finally, this part summarizes the current development of domesticand international network group-purchasing.As an important part of the thesis, the second part is “the main problems of our currentnetwork group-purchasing”. The part is based on the main part in the market transactions, andanalyzes the problems of network site, consumers, operators and the government, including:buy site’s access mechanism, monitoring mechanism and vulnerable protection mechanism;consumers’ irrational consumption; operator’s false propaganda, and different treatment, aswell as the problems of the government’s macroeconomic control. The third part is “the legal protection status of online shopping at home and abroad”.The nature of the network group-purchasing is a new e-business model, which is not out ofonline shopping area. So what the article described in this section is the electronic businessstatus of legislation at home and abroad, such as the United States, Germany and the EU.The fourth part is “protection measures to improve our network group-purchasing”, thekey part of this article. This part is mainly to put forward corresponding solutions for theissues of the third part. Network group-purchasing is at the preliminary stage of development,so it is not suitable to make the specialized norms for the development. On the contrary, weshould analyze the plight of e-commerce and online shopping to put forward the regulatesolutions at the same time during the process of analyzing and solving the problems ofnetwork group-purchasing. Therefore, this part want to set up barriers to entry and cleardivision of responsibilities for network group-purchasing site; set up “cooling-off periodsystem” for protecting consumers; strengthen the operator’s obligations at regulating theoperators; propose to formulate the E-commerce Law and establish the social credit system atthe government’s macro-control level. By the construction of related system, the part is toeliminate the problems of our network group-purchasing and promote its healthydevelopment.
