Due to imperfection in both theory and practice for International Refugee Law, the author holds that the protection of refugees’ rights and interests remains an important part of international laws.The thesis is composed of preface, main body and conclusion parts. The preface mainly involves discussion of the status quo of protecting refugees’ rights and interests under the current international background of "global peace mingled with turbulence". As both theory and practice of international law for refugees are underdeveloped, protecting their rights and interests remain a keynote in international law.The main body is separated into four parts:the first part mainly involves root cause, development of definition in three phases, defining of establishment and loss of refugees’ identity, and overall discussion of International Human Rights Act and War and Armed Conflict Law which are closely associated with refugees’ rights and interests. The second part mainly discusses the protection issue, especially corresponding international law, and dwells on efforts made by international community and some countries. The third part is the main part which is concerned with the protection under regional war. It illustrates relevant laws and regulations on living rights, health rights, permission and repatriation by permission countries reinforced by the current situation of refugees in war areas. The last part dwells on China’s protection of NK refugees caused by a possible war in Korean peninsula with armed conflicts as entry point, and further illustrates China’s law stipulation concerning protection of refugees’ rights and interests.The conclusion part emphasizes on internationally mutual cooperation and communication based on the status quo of protection of refugees’ rights and interests by international community under regional war, in aim to achieve peace around the whole world.This thesis is innovative in three points:firstly, it’s innovative in focusing on international refugees generated through a regional war in the current and future times; secondly, it is innovative in discusssion of the refugees’ differentiation, repatriation, guarantee of their human rights in the foreign country and orderly administration based on international law; thirdly, on the background of China’s deficiency in the legal system of protecting refugees and the possibility of the Korean Peninsula war, it’s forward-looking in the exploration of stipulation and improvement of China’s laws and regulations regarding China’s protection of the human rights of various refugees including those generated by warfare.
