The Criminal Law Protection Of Trademark Rights

The phenomenon of trademark infringement crime is becoming more and more serious in our country and it has an opposite effect on the development of market economy. The protection on criminal law of trademark rights started relatively late in China. What’s more, some of the existing law exists some questions need to be discussed at the legislative level and some other existing law exists vague understanding at the judicial level. According to this situation, this paper put the legal basis of the protection on criminal law of trademark rights as an entry point and the main measuring stick, analyzed the lack of the criminal law of trademark at the legislative level in China and put forward some suggestions. In consideration of solving the problems in the judicial practice, this paper also analyzed some difficult problems of the criminal law of trademark at the judicial level, expecting this work would be helpful in criminal law theory research and judicial practice on this topic.
