"Homicide Cases Must Be Solved" In The China Context

Doubts and worries are never far from the principle of "Homicidecase must be solv ed", a basic principle in dealing with criminal case, since it comes out, and the criticism on this principle in the field of academy is, also, increasingly growing. After the discussi on about the principle from the light of epistemology and logic, this paper analyses the t heoretical source of the principle on the basis of theory and practice. At the same time, t he paper, through elaborating and analyzing the developments, problems and reasons of the principle of "Homicide case must be solved", puts forward the new principle of "Ho micide case must be solved". The author tries to makes the contribution to the improve ment of Chinese criminal institution by the new definition of the criminal principle, and hence broadening the theoretical field of criminal case research and serving the practice of cleaning up the criminal cases.There are5parts in this paper. The introduction mainly gives the background and meaning of this paper, as well as the research outcomes on the principle of "Homicide c ase must be solved" in current academic field. The first part describes the history backgr ound, basic conceptions and theoretical sources of the principle. The second part, after e laborating the truthiness or not of the statement about this principle, dialectically criticiz es the principle. The third part gives a profound consideration about the influence of the principle and analyses the realistic problems of the principle on the foundation of the ori ginal one. On the basis of theory and practice, the fourth part puts forward the principle of "Homicide case must be solved" and explains it in the light of consciousness, target, s upervision and remedy measures, and hence optimizing and improving the method of cl eaning up criminal cases.
