Study On Legal System China’s Exploitation At International Seabed Area

Development System of International Seabed Area is a part of United Nations Convention on the Law of the Sea (UNCLOS as follow), it was established and evolved step by step for the orderly exploration and development of the international seabed area. Development System of International Seabed Area is based on the fundamental principle of the common heritage of human. Our country have insufficient basis in international law, but the domestic basis are policy for development as a maritime country and important developing countries of the international seabed area and there is no legislative on Development of Seabed Area. Therefore, it is necessary to conduct in-depth study of the legal system of the international seabed area, and there is an urgent need to build the domestic legal system of the international seabed area development to safeguard the related benefits of our country.This paper is based on international legal theory, concerned about the building of domestic legal systems of International Seabed Area which mainly discussed in four parts:Part Ⅰ:Generalization of the concept and content of the development system of the international seabed area, analyze framework of the legal documents, the implementation of legal documents and other legal documents.Part Ⅱ:Practice and the legal basis of the system of regional development of China’s International Seabed. This part summarized and analyzed the present situation of international seabed area development system from the position of the participating institutions, institutional practices, development practices.Part Ⅲ:The status and analysis domestic legislation of developed countries on the international seabed area. This part started with the legislative background of regional development of developed countries, and then summarized the main legislative content to provide a reference for our international seabed area legal system.Part Ⅳ:The construction of our country’s legal system of international seabed area. This part of paper proposed the principle of the domestic legislation of international seabed area in china should follow based on the discussed and analysis three part above, then proposed the legislation mode suited to china.In the last, this paper made some feasible recommendations for our country’s legal system of international seabed area in these aspects:confirmation of the subject, exploration of the subject, rights and obligation in exploration, institutional review and the protection of the marine environment.
