Research On Juvenile Justice Diversion System

Based on the "Junior Event Protection Act" in Taiwan area, the relevant laws and regulations and the status of implementation of juvenile justice diversion system are introduced in this paper, and with the regulations and implementation of the juvenile diversion system in the United States and Hong Kong, the related theoretical basis and the relocation patterns of the Juvenile justice system are also introduced and researched. Besides, in order to promote the construction of the juvenile diversion system in China in the future, the juvenile diversion system in Taiwan area are analyzed, summarized and perfect. The teenager is related to the future of a nation and the hope of a people. However, the growing problem of juvenile crime is plaguing the world. How to prevent and correct the juvenile delinquency has aroused general concern to the world. A series of legal documents relating to the juvenile justice system such as "Standard Minimum Rules for the Administration of Juvenile Justice","Protection of Juvenile Delinquency", and "Prevention of Juvenile Delinquency" are stipulated by the United Nations. Owing to young body and immature mind, the motive for the juvenile crime, ends and means of the juvenile crime are relatively simple, and easy to correct after crime. So different criminal procedure from the adult criminal should be applied to save the litigation costs and smooth the litigation, which protects the legitimate rights and interests of the juvenile delinquency more powerfully and turn juvenile criminals to a normal social life as early as possible. The juvenile steering system is one important system in the juvenile justice system for its remarkable protective effect. In this paper, with the protectionist spirit and the national conditions in China, by making the historical analysis, comparative analysis and literature analysis, the regulations and the status of implementation of the juvenile steering system in Taiwan area are learned, and the developed experiences of the juvenile diversion system in the United States are used for references, in order to enrich and improve our juvenile procedure.Apart from the guide implication, four chapters are introduced. The first chapter is the overview of the juvenile justice system, introducing four implemented types, juvenile crime theory and diversion concepts in the various national juvenile justice systems. The second chapter introduces the diversion system and case mode in the United States and Hong Kong for references. The third chapter introduces the juvenile justice steering system in Taiwan area, analyzing from two aspects:the regulations and the status of implementation of the steering system in Taiwan area. Chapter four summarizes the preceding part of this paper, makes related suggestions, and envisages a reasonable juvenile diversion system in China.
