With the rapid development of China’s network, online games havebecome a new way for leisure, more and more people experience to theinteresting online games. The rapid development of the network has broughtthe popularity of the online gaming industry, but accompanied by the riseof online games as well as the growing cases of crimes against virtualproperty. New crime for virtual property of online games emerge in anendless stream, the impact of the existing legal rules, which need to besolved urgently.In this essay, Writer tries to analyze the concept, thecharacteristics of online game virtual property, clear its legalattribute, qualitative different violations of the online game virtualproperty behavior. Trying to establish the value of assessment methods,strengthen the protection of online game virtual property protectionsystem.The essay is divided into four chapters.The first chapters is to define the network virtual Property. In thispart, introducing the basic problems on network virtual property, forexample, the origin of online game virtual property, definition, property attribute, character and the necessity of protection. Writer introducesfamous “china first case on virtual property”,namely the case of LiHongchen v. Beijibing, which lifts Chinese research curtain on online gamevirtual property.The second chapter analyzes the behavior type in the main violationsof virtual property of online games, which is controversy in thediscussion, tries to demonstrate whether such acts constitute a crime.In the third chapter, Writer establish a comprehensive and dynamicevaluation method, which provides a theoretical means for the judicialpractice of conviction and sentencing. That is set up social institutionsto assess the value of online game virtual property or clear the rightsto specific government functional departments, the average cost to gamethe cost of operators and the general game player needed to make a specificvirtual property as the basis, combined with the virtual propertytransaction market prices and other factors to determine the online gamevirtual property value.The fourth chapter discusses the construction of the legal protectionsystem of online game virtual property. Proceed with two aspects from thelegal way and the non-legal way, not only from the criminal law and otherlaws to strengthen the protection, but also from the three aspects of gameplayer, operators, the government and the media to strengthen the dailyprotection, effectively prevent the invasion of online game virtualproperty cases.
