The Third Conference on the law of the sea under the new characteristics and thenew situation of each country in open waters, the four freedom of the seas was citedfor the expansion of the six, namely:1, freedom of navigation, overflight rights;2;3,the laying of submarine cables and pipelines free box; artificial islands4, constructionof the international law permitted and other equipment free;5, free fishing;6, thefreedom of scientific research. Fishing on the high seas, one of the six freedom of thehigh seas freedom ranked countries enjoy. Marine resource is always an importantresource for human life and production activities.Grotius in accordance with the father of international law point of view, the highseas fisheries resources is extremely rich, the country has the freedom of fishing rightsshall not be subject to any restrictions, but with the technology of human science andtechnology progress, and human fishing has been greatly enriched and improved. Andfishery production mode to the rapid expansion, marine fishery resources are facingthe danger of continuous depletion. Especially after the Second World War, with thedevelopment of science and technology and the improvement of management level,strong to promote the development of pelagic fishery, the world catches increasedsharply, however, some of the major traditional fishery resources appeared to declinephenomenon. Thus, people also began to gradually realize that, although can usemarine resources and regeneration, but it is not inexhaustible, be inexhaustible. Nearlyhalf a century, the international community by formulating the international convention, treaty or agreement form, on the high seas received a relatively largelimit.The first chapter is an overview of the right to freedom of fishing on the highseas, including a brief introduction on the high seas and the high seas fisheries of theconcept, contents and characteristics of high seas fishing rights, the formation anddevelopment of the freedom of fishing on the high seas, and establish the foundationof the right.The second chapter is on the high seas by fishing rights in the restrictions wereanalyzed and discussed. Focuses on the relevant treaty is discussed, especially thehigh seas four convention,"the United Nations Convention on the law of the sea",through the analysis of the relevant conventions and treaties, the establishment of theright of fishing on the high seas, and constraints.The third chapter mainly talk about the influence of the freedom of fishing on thehigh seas in international cooperation, especially through the analysis of the nature ofglobal fisheries organizations and regional fisheries organizations and differentfunctions to show the effects of fishing on the high seas, right new development andrelated organization for fishing on the high seas fishery right.The fourth chapter mainly writes perfect fishing on the high seas system and thelegislation of our country, mainly discusses the related legislation of our country highseas fisheries system and practice, reflect the deficiencies in our legislation and thedevelopment direction in the future, so as to improve the construction of China’srelevant legal system and better protecting our Ocean resources.
