The period of social transformation is not only of a social reality, butalso a changing critical period of the modernization of the nomocracy inChina. During this special stage, Legal reform and rules of governancewill face the conflict of old and new social consciousness, politicalsituation in the undercurrents, the market Interest group struggleproblems arising. In this paper, standing on the perspective ofeconomics and sociology of law, starting from the characteristics ofChinese traditional society structure, through the analysis andsummary of the Chinese legal system reform in social transformationand a variety of practical problems modernization encountered, attemptto summarize the future direction of Chinese legal systemmodernization and the contemporary levels of Chinese socialtransformation rules.The first chapter analyzes the social order and rules of governanceof Chinese traditional society based on ultra-stable social structuretheory; Followed by the analysis intrinsic motivation of China’sopening-door leading to the whole social context of present China’sopening-door and social transformation, explores internal relationsbetween opening-door policy of Chinese society and the rule of lawreform.The second chapter describes the many crises encountered in thelegal system reform of Chinese social transformation. In the terms ofChinese social transformation system, democratic system of majorityvoting paradox questioned in public choice theory; Traditional socialstructure and social governance ideas and the conflict betweenstructure of the social transformation and the concept of the rule of law are in particular in: conservative inertia of thinking on theconstitutional reform, the distinction between town and country, thefrustration of social control in rural area, disorder and chaos of themarket filled with opportunistic to rise to a market economy.The third chapter mainly states multiple rules in treatmentdemonstration project of conditions in social transformation. With theresolution towards Arrow Impossibility Theorem framework, theavoidance of voting paradox shows that Chinese legal rules andgovernance improvements can follow two paths: through a suboptimalimprovement on the constitutional reform, The governmentre-positioning in the market regulation, legal ideology investment andsome other respects discussed the desirability way about smoothtransition in Chinese social and legal. Enhance the efficiency of socialorder through the fusion of multiple rules, ultimately to achieve the goalof the modernization of the rule of law and smooth socialtransformation.
