Research On Creditor’s Rights Investment Assessment System

Creditor’s right is the most important form of property in the modern propertysystem. As one of the form of non-monetary properties, creditor’s rights has legalbasis in the present system of our company law. But the terms about the laws of thecreditor’s rights investment assessment system appears rough and crude. This paper,which is on the basis of admit the legitimacy of claims paid and by reference torelevant foreign laws and regulations, propose specific recommendations of creditor’srights investment assessment system in China’s company law. This paper is mainlydivided into three parts:The first chapter is theory analysis of creditor’s rights investment and assessment.First propose the basic concept of Creditor’s rights investment and the non-monetaryproperty investment. Then discuss current legislation of creditor’s rights investmentand value evaluation, and analyze creditor’s rights investment assessment system inour country.The second chapter is put forward strengthen the investment assessment is thepath of creditor’s rights investment. Through the elaboration of creditor’s rightsinvestment assess the feasibility and necessity of two aspects, demonstrates themeaning of the construction of creditor’s rights investment assessment system.The third chapter is put forward concrete suggestions to perfect the creditor’srights investment assessment system. The first part establish a unified, scientific, reasonable creditor’s rights and value assessment system, to ensure the authenticityand fairness of the creditor’s rights. The second part improve the system of creditor’srights investment assessment supervision，which is consistent of investment reviewand the public,. The third part improve responsibility mechanism of creditor’s rightsinvestment assessment according to the four types of main body.
