Research On Assessment Institution Of Local Legislation Quality Guarantee

Legislation quality problems such as unauthorized legislation,legislative conflicts,departmental benefit orientation,lacking of local characteristics and nonstandard technical has seriously affected the scientific and democratic aspects,effectiveness and authority of local rules and regulations.The good news is that,in recent years,China's legislative subjects actively explore various ways and means to improve the quality of legislation.Local legislation evaluation is an important step in the process of legislation,it will not only help improve the democracy and scientificity of our country local legislation,but also greatly improve the implementation efficiency of local regulations.But unfortunately,the legislation assessment in our country is still not a legal gap.There is no corresponding regulation in "the legislative law",which leads to great differences on evaluation standard,method,and procedure.It is harmful to the impartiality of the appraisal conclusion.How to better improve local legislation assessment becomes a problem urgently to be solved.At present,the legal theoretical research on local legislation evaluation system is still in its infancy,blank of practical exploration and theoretical research makes it significant.According to "the legislative law" regulation,introduction in this paper shows the extent of the current local legislative agents.Local legislation specifically refers to National People's Congress legislation,especially the larger city.Based on the local law quality analysis of existing problems and the reasons,legislation pre-assessment before the evaluation system,local legislation assessment standards and local legislation assessment procedure are focused.Finally,the author attempts to put forward suggestions of perfecting our country's local legislation assessment system,mainly includes: making up the lack of legislation before the evaluation system,strengthening the extent of quantitative evaluation criteria of local legislation in our country and improving legislation assessment process specification.
