The public library is funded by the government, in order to promote thedevelopment of education in the nation. It is a nonprofit organization. The publiclibrary legislation is in order to protect a natural choice for the smooth development ofpublic libraries. Western developed countries began to make library legislation in thebeginning of the19th century. Now, more than80countries all of the world hasspecial legislation on the library, issued a total of more than250bills, including theNational Library Act, the Public Libraries Act and related laws.China’s legal system is not perfect, until now, there is no any library laws. But noone was to ignore it all. Since the eighties of last century, China has began to lresearch the public library law. In2008, the Ministry of Culture decided to makepublic libraries legislation, and this decision make to a climax. in2010, the PublicLibraries Act (draft) has been published and ask people’s comments.The Public Library Law (draft) written by Professor Li Guoxin. This text hasmore than4500words, the main part of forty-six can be divided into seven content,including general principles, the establishment and functions of the National Library,the establishment of public libraries, and functions of the Document InformationResources Development, Library Services, workingpersonnel, legal responsibility.Although the draft has a certain elaboration to these seven parts, but is not quitedetailed. This article discusses three aspects including the ensure funding of publiclibraries, a free and open system, the rights and obligations of the reader.To proposedlegislation Public Library imperfections.The first chapter describes the background of public library legislation at homeand abroad. Then elaborate the research method and research significance of thepriorities and innovations.The second chapter Public Library Law (draft), mainly discusses the basic theoryof the Public Libraries Act, and the contents of the draft system.Chapter Three legislation is to protect and improve the public library system offunding.Major contrast to foreign public library legislation and our localadministrative regulations on the protection of the source of funding of publiclibraries, to find the problems of our public libraries and proposed solutions.Chapter Four improve legislation to protect the free and open system of publiclibraries, firstly discusses the legal basis of a free and open system of public librarieswith practical needs, and then expounded the contents of the free service content andnon-free services.Finally elaborate freeopen policy both has opportunities andchallenges exist.Chapter Five legislation to improve the rights and obligations of public library lead to the thinking of the rights and obligations of the conflict as a case of HangzhouLibrary, readers should be legislation on the rights and obligations of this view.
