In order to ensure drug safety, most of the world’s major countries commissioned the production of drugs and their responsibility to conduct strict rules. Nevertheless, medical OEM damaging event still occur frequently. Due to the limitation of understanding medical OEM, the responsibility of medical OEM has not been detailed, and Special relief system has not been setup, so that the identification and relief of such liability become a problem. How to determine the liability of medical OEM and implementation of appropriate relief to the victims, is he problem that this article want to solve. This article defines the medical OEM and its responsibilities, focused on the responsibility commissioned the production of pharmaceuticals, relief system and so on. On this basis, Analysis of problems existed in medical OEM responsibility system in China, experiences from Abroad, make relevant improvement measures, in order to providing some useful information for perfect the law system of pharmaceutical production by medical OEM in our country. The essay is made up of four parts:In the first part, we will talk about the basic theory of medical OEM. And expounds the connotation of the medical OEM and its legal liabilities. In the scend part, we analyze legal responsibility of medical OEM. Content mainly includes the subject of responsibility, identification of responsibility for breach of contract and liability of tort, relief and so on. The third part analyzes the problems of medical OEM’s legal liability system, for instance, the legislation, identification of liability and relief. In the final part, we focus on the improvement of medical OEM legal system.
