With the improvement of people’s living standard and the development the oftourism industry, tourism has become one of the main forms of entertainment.Tourism rights has come into the public horizon. Tourism bill of rights defines theconcept as:"The rights of everyone to rest and leisure, reasonable limitation of workinghours, periodic leave with pay and freedom of movement without limitation, withinthe bounds of the law, is universally recognized."Since then, tourism rights becomes theessential topic of tourism development. Many countries have pay a lot of efforts tosafeguarding this rights. In the process of establishing constitution China’s tourism law,there are a lot of argument about tourism rights, and it is incorporated into the draft oftourism law.Tourism rights is a kind of person’s (subject) justicial advocation about touristinterest(object). It mainly includes the rights of paid vacation, tourism freedom, equaltourism, tourism resources sharing etc. Essentially speaking, tourism rights is a humanrights, which is the fundamental rights of citizens. The rights takes freedom, equality,justice, harmony as the it value goal, and that all values are attributed to the all-rounddevelopment of people.The realization of rights is the ultimate destination. Tourism rights has practicalsignificance for people only if it becomes reality rights. Therefore, to realize tourismrights has become the focus of this research. Tourism rights realization has two meaning.In a narrow sense, tourism rights realization refers that travel requirements, wishes, andgoals comes into reality. It means that the people’s tourism demand is satisfied, and itemphasizes a result, which becomes fact. Broadly speaking, it means tourism rights turninto the specific provisions of the law, and be used, put into effect, performed. So, therealization of rights is a dynamic process that tourism demand is satisfied, and it includespecial tourism rights realization. In the process of realizing tourism rights, should payfull consideration to the objective conditions. To pursue high degree of tourism rightsrealization blindly is improper. The process of tourism rights realization include threephase: legalization, implement, realization. Legislation-regulating, market-adjusting,policies-guiding and social participation are four mian mechanism for tourism rightsrealization. As our country is at the stage of the legal legalization step, it is proper toestablish a legal protection system for tourism rights to realize, considering threeaspects: constitution, basic law of tourism and local tourism laws and regulations. Putforward some suggestions on the law enforcement and judicial.
