| Power transmission and distribution projects usually have long construction periods, involve various stakeholders and are faced with increasingly complex legal risks nowadays. Proper assessment of the legal risks in the enterprises’development, appropriate preventive measures based on the assessment results and the improvement from post-processing to advanced-prevention are all helpful in regulating corporate behavior, safeguarding their rights and interests and developing harmonious enterprises. Managing enterprises according to the law shows significant point in preventing corporate legal risks, promoting scientific development of the electricity grid system and supervising on the basis of the law. Therefore, the study on legal risks management of transmission project has both theoretical and practical significance.In this paper, literature research, qualitative and quantitative analysis, induction, Questionnaire Survey and case studies are adopted. Firstly, the paper elaborated the basic theories and methods of project risk management, followed with an analysis of the current situation of legal risk management in power transmission and distribution projects in our country, which includes the analysis towards the characteristics of the project, the construction procedure, the significance of risk management and the characteristics of legal risk and legal risk management. Then, a detailed analysis of legal risk factors in various stages of the power transmission projects is established, and proper responses to the legal risks of all stages are given correspondingly. Afterwards, the paper takes the Lang-fang Du-Guan-Tun110kilovolt power transmission project as an actual case, adopting the management order of prophase preparation and project implementation phase, carries out an overall feasibility study in terms of legal risk recognition, assessment and control. This actual case verified the theoretical analysis and investigation’s feasibility, rationality and reliability of Legal Risk Management in Power Transmission Projects. Finally, the conclusions of the paper are drawn and some pertinence suggestions based on the situation of our country are come up with. Such as the establishment of Power Transmission Project legal risk management system, innovation of legal risk management methods and risk control mechanism and improvement of the integrity of legal risks. |
