Legal regulations have important influence on Chinese electricity system reform. Chinese electricity system reform started in early 21 th century, and until now electricity transmission and distribution system reform has already become an essential link to push forward Chinese electricity system reform. The core step is to separate the electricity transmission and distribution in the reform. This dissertation will try to research on which separating pattern of electricity transmission and distribution suits our country well and how to design the laws to regulate all the parties after separation.Electricity and its transmission and distribution, closely related to our daily life, have different and special features both in physical and legal aspects, and that these different and special features will make our law design difficult. Some theories from economics and laws demonstrate it is necessary to separate the link of electricity transmission with electricity distribution, and once these two links separate, we will cultivate a more efficient electricity market and gain the lower electricity price.When scanning the current Chinese laws about the electricity transmission and distribution, we will see that not only we have never built a definite regulation system of electricity transmission and distribution, but our current legislations are simple and disorder, which can hardly take effects on guiding our electricity reform. The lack of legislation has become one of reasons that our electricity reform comes to a halt. That how will we design our regulations depends on our selection of reform patterns. Overseas experiences in electricity reform indicate that there are different separating patterns of electricity transmission and distribution system, and our country is supposed to follow the path of overseas countries’ reform, on the condition that we do not abandon our current economic and political conditions.To sum up, we should endeavor to figure out what to learn from overseas experiences and how to make innovation in legislation.
