A Juristic Research On Circulation Of Collective Construction Land

At present, many issues lay on the juristic system of the circulation of collective construction land, which is not only a reflection of the contradiction of both the legal system and the legal theory, but also not consistent with the reality in a serious way. It declines the development of the society, thus, the reform of legal system of collective construction land shall be imperative.The reform of legal system of collective construction land is a complicated course, including not only the revise of relevant contents of collective construction land, but also major issues, such as farmland preservation and famers’survival and development, which requires an overall and thoughtful consideration, as well as the improvement of relevant supporting measures. Nowadays, positive and beneficial explorations are conducted nationwide, which helps to accumulate much successful experience, except for some deficiency. Therefore, I am to raise a series of constructive and legal measures, analyzing the existent issues of collective construction land in a professional way, with the understanding of sociology and advanced experience from pilot projects in different places, along with research methods, such as empirical analysis, comparative analysis and value analysis.This essay is divided into four parts, excluding introduction and conclusion.The first part:descriptions of the circulation of collective construction land, which focus on concepts, features and legal system of this circulation.The second part:an analyze of the existent legal issues of circulation of the collective construction land. This part is divided into divisions. The first division is about the disunity of the legal regulations in the legal system of circulation of the collective construction land. The second part is to elaborate the contrary content between the legal system and legal theory. The third part is to describe the disjointed situation between the legal system and the reality.The third part:an introduction of local experience for the circulation system of collective construction land, which select four typical pilot places, including Wuhu, Anhui Province, Guangdong, Tianjin Binhai new area, and Chongqing. A conclusion is made on the specific measures that are taken in the four places. A commentary of experience and deficits is made to better reform the circulation system of collective construction land.The fourth part:a specific scheme is raised to reform the circulation system of collective construction land. The reform includes three aspects, which are the revise of relevant legal laws and regulations, timely follow-up of supporting measures and implementation of state macro control.From my prospective, many issues lay on the active circulation system of collective construction land, therefore, actions should be taken to release the circulation, however, the major issue of reform still relies on the overall implementation of supporting legal measures.
