Land is the foundation of the people’s livelihood and land reform is a matter of national economy and people’s livelihood. As an agricultural country, China’s problems on the land issues often are more outstanding than others. After the Third Plenary Session of the 11 th Central Committee, land reform becomes the new problem of the people’s livelihood, with the development of economy. The existing land system is more and more not adapt to the development of our urbanization requirement well. Land circulation is the key to land reform. The current land circulation system has formed the urban and rural dualistic land circulation patterns.In this kind of dualistic land circulation mode, the mode of collective construction land and the state-owned construction land use rights transfer of culture issues become more prominent. This article comes from the current main problems of rural collective construction land use rights transfer and aims to analyze the cause of problem. The second part contains two aspects of theory and practice to explore the feasibility of the collective construction land use rights transfer. Behind the three parts is the part of the article mainly discusses which collective construction land use rights transfer legal system built in China put forward its own system.
