| Since the establishment of Education system of reeducation through labor in1957,it has played an irreplaceable role in building a harmonious society and the correction of minor criminal.But, it also has suffered from the academic controversy and doubts on many dimensions,such as the system of re-education through labor restriction of personal freedom,with non-legal norms, lacking of supervision when making reeducation-through-labor decisions, Violations of human rights in the Forced transformation process and so on. All the problems and shortcomings has presented us with an unavoidable problem----making it a virtuous order to protect human rights and to maintain orderr by eforming the system of re-education through labor reasonable reasonabely. To this end, the author made a research in Authority of re-education through labor and a Management of re-education through labor in Shanxi Province. In this reaserch,the author has found many problems. There are common problems in our country, and also unique problems only in Shanxi. These problems can be summarized as follows:1. Public security organs exclusive the right of deciding, Labor parenting Committee becomes a mere figurehead;2. The period of re-education through labor is too long and the punishment is too harsh;3. These people, who have been taken to a reeducation-through-labor measures have no social security when the were free. By analysis of labor education system in Shanxi Province, the author proposes her own thinking about how to reform the reeducation through labor system. We can make efforts from the following aspects:1. Abolish the old system, and establish a new system;2. Defined the intended scope and conditions of the new system;3. Set magistrates’court, and strengthen the supervision of the prosecution;4. Promote the construction of employment guidance and the social security system. Author’s research and recommendations are not perfect, and need to be improved yet to give useful proposals on the reform of the labor education system. |
