The Study Of Criminal Trial Informatization System

With the proceeding of information technology evolution, the criminal trial has begun to engage in the progress of informatization, which can not only solve some various bottleneck problems of criminal trial procedure, but also contribute to promoting the justice, publicity and efficiency of judiciary in China. Since the informationizing of criminal trial is just started in recent years and there are still many critical issues need to be discussed, this study therefore presents theme-around understandings and suggestions based on literature review, consulting advanced experiences and cases studies in both domestic and foreign countries, using a comprehensive method including comparative analysis, empirical analysis, statistical analysis, logical theory, as well as value analysis.The thesis is organized in following four sections.The first section describes the concept of criminal trial informationization, analyzes the current condition and underlines its significance. From the results of investigations and reviews, the state quo of criminal trial informationization can be mainly summarized as three perspectives:incomplete system, inadequate implementation and imperfect system. Some related discussion is also expressed in this chapter.Section2addresses the definition, concept and function of digital court, which serves as the technical support of the criminal trial informationization.In the third section, according to the most advanced information technology, four manifestations of the criminal trial informationization are redefined and reclassified, namely network broadcasting of court trial, multimedia evidence demonstrating, audio-visual technology, and remote trial. This chapter emphasizes that the network broadcasting of court trial should be identified as the only representation of informatization, proposes that the application of multimedia evidence demonstrating need be expanded rather than only available in public prosecution, clarifies the definition and classification of audio-visual technology, and also suggests that remote trial could be promoted, and its four specific forms are also explicated as well. Through the above analysis, the scope and means of information technology application in criminal trial are validated, with the aim of solving inadequate implementation.In the view of existing problems in network broadcasting of court trial, multimedia evidence demonstrating, audio-visual technology, and remote trial, Section4proposes relevant institutional solutions, and addresses the issue of imperfect system. as the goal.In a word, through analyzing the basic conception, technological support, specific performance and system establishment, the study formulates a general framework of criminal trial informationization.
