Research On The Role Of Institutional Justice In Constructing Harmonious Society

Since the16th central committee of the communist party of China fourth plenarymeeting put forward to construct a socialist harmonious society, constructing the harmonioussociety has been a strategic objective of the common efforts of all members of the society.The people of the whole country promote the construction of harmonious society. In thisimportant historical period, realizing the justice system has a very important effect on theconstruction of hharmonious society. Fairness and justice is one of the basic requirements ofthe harmonious society and the most proper environment atmosphere for sustainabledevelopment of a society. Justice and system is the relationship between soul and carrier. Theabstract justice is embodied in people’s life by systems to regulate the behavior of people,inspire people to be diligent and work hard, motivate people enthusiasm, resolve thecontradiction between people and let people personally feel a society of equity and justice. Inlooking back at the past five years of work and the basic summary of ten years, or in thedeployment of the party and the country’s various undertakings, our party lies emphasis up onsystem construction. Syestems, the two words, are through the whole report of the18th CPCNational Congress. Visibly systems in our country have played a significant role in socialdevelopment. In the process of building a harmonious society emphasizing the institutionaljustice is inevitable. This paper is five parts and text content is four parts. According to theMarx justice thought, freedom thought, system ethics and legal philosophy, combing with thepractice experience of China’s socialist construction, I am thinking of the realization of theinstitutional justice and discussing institutional justice playing an important role for theconstruction of a harmonious society in China’s social transformation based on the presentsituation and the background of building a harmonious society. This article first introduces theconcept of institutional justice and basic characteristics. The article further elaborates someinstitutional justice thoughts origin in the basis of understanding related concepts and thesignificance of the institutional justice to build a harmonious society. The article points outthat the main impact factors to realize the institutional justice in the process of building aharmonious society and puts forward some exploratory ideas to realize the institutional justicein the end. The first part is the introduction. This paper introduces the origin, research results andresearch status at home and abroad.The second part is to institute justice concept, basic characteristics, main functions andanalyse the origin of thoughts. Very early history of justice discussion, justice has alwaysbeen the value target of desire and pursuit, but the institutional justice research is relativelylimited. Systems and justice are the relationship between the carrier and soul, but it is not thesimple combination. Justice is the moral evaluation criterion of systems and reflects degreesof public acceptance of systems. Marx’s works express institutional justice. This paperpresents the arrangements to readesrs, so that readers can basicly understand those expression.At the same time, it also introduces some western justice thoughts development situation.The third chapter is mainly about the importance of institutional justice for theconstruction of harmonious society. Order is necessary conditions for realizating harmonyand the basic conditions of human survival and development. Institutional justice can becontinued to maintain social harmony order. Freedom is the ultimate goal of a harmonioussociety. Institutional justice is the basic conditions for the realization of a harmonious societyand ensure personal freedom, so it can help to achieve the goal of freedom of a harmonioussociety. Coordinating the various interests is one of the elements of the realization ofharmonious society. Through the system to coordinate the various interests is the most correctmeans. It can play a high efficient role and properly coordinate the conflicts. Institutionaljustice guarantees the realization of economic justice, creates a good economic frameworkand promotes the benign economic development. Reasonable and perfect the system ofjustice is the basis of fair justice. Only with the help of restriction and guarantee of systems,we possibly talk about the fair and justice.The fourth part points out the main obstructive factors to realize the institutional justicein the process of building a harmonious society. In the history, our country was rules by manand human ethics replaced the fair justice. In order to realize a country under the rule of law,we need to break the habit. Individual interests sacrifice for public interests and service themin times past. With the accelerating speed of building a harmonious society, we nowemphasize the individual interests and strengthen the consciousness of human rights. Becauseour country is still not fully realize harmonious society, China’s regional economicdevelopment and cultural level are not synchronous and very different. So that the result isthat people in different parts are the different to the justice concept in understanding anddefining. The judicial activities fair also has important significance for the realization of theinstitutional justice. It includes to establish and enforce the law. Justice is the last defense of social security. Judicial activities are carried out smoothly for the construction of aharmonious society to create a good social environment. If the judicial activities appearedparalysis, the whole society will be a disaster.The fifth chapter is about the realization of institutional justice problems. Withincreasing the course of building harmonious society, times need free as the ultimate goal ofharmonious society. We need to struggle for the communist society. So, it is necessary toemphasize the freedom has an influence on institutional justice. Free principle is thetheoretical basis of the existence and development of institutional justice. Realizing theinstitutional justice should have an evaluation criterion to guide us how to innovate systems.The criterion tells us what the system is justice or closes to justice. Institutional justice isdivided into substantial justice and formal justice. Not a single one can be omitted. Thecultivation of system consciousness creates a good social atmosphere for achievinginstitutional justice. All system activities depend on people to complete them. Whatevermakers, performers or observers all need a high degree of recognition and respect for systemsin the consciousness. In the process of the realization of institutional justice, the supervisionof system makers and enforcers is indispensable. Justice is reflected in two links of lawenforcement and legal formulation.
