The Legalization Of Electronic Seal Management

The Electronic Signature Law of the People’s Republic of China was passed by the Tenth NationalPeople’s Congress Standing Committee11th meeting on August28,2004, and it was formallyimplemented on April1,2005.It is the first law in the field of information technology in China, andprotect the security of electronic transactions from the legal system, and promote the development ofe-commerce and e-government, and create a good legal environment for the development of electronicauthentication service, and laid an important foundation for the establishment of e-commerce securitycertification system and network trust system.With the implementation of the "Electronic Signature Law", many IT companies started to developand promote electronic seal products in China, and the electronic seals market has entered a period ofrapid development. The application of the electronic seal technology has covered the e-governmentsystem at all levels of government, the security of credit application in the field of financial, theconveying of military decree, the application of the design process in the CAD/CAM field, themedical mobile clinical systems and the distance education system, the electronic transactions,electronic contracts and many other areas. Since China doesn’t sort out specific management accordingto the characteristic of the electronic seal, and doesn’t specify a clear competent department, and doesn’testablish an application and service system of electronic seal for the whole society, the absence ofelectronic seals management mechanism has become a major bottleneck restricting the development ofthe electronic seal, which limits the role of the electronic seal playing as the evidence of credit, and ledto the lag of establishing of the credit system in China’s information technology.In view of this, this paper attempts to sort out the electronic seal management issues to rationalizethe management mechanism of the electronic seal, and analyze several key issues in the ManagementLegalization of electronic seal deeply and then put forward legislative proposals on the management ofelectronic seal. This paper attempts to draft up “the approach of management of the electronic seal "(just an academic proposal) to provide a reference for the legislature or the management department ofelectronic seal and so we can advance the process of the implementation of the electronic sealmanagement Legalization, and thus regulate the practice and management, and enhance the applicationof the electronic seal in the e-commerce and e-government, in order to build a credit system based onthe application of electronic seal in information environment,and then improve the efficiency forgovernment,business and personal work in the information age, and facilitate people’s lives.
