Especially for China, our country is a huge agricultural production and consumption power since ancient times. To seek more stable and constantly grain production, human beings never stopped to seek their way to avoid natural disasters, and to improve the production, our discovery such as chemical pesticides does improve the per mu yield, meanwhile, also have a significant impact on the whole environment. As Abbott Schmitzwiese said:"It is difficult to identify the devils which are created by themselves."In rural areas of China, land resources are close to exhaustion by excessive exploitation. We are using a large number of man-made chemical fertilizer, agricultural medicine, plastic, catalyst etc. The current agricultural soil pollution is quite serious; it can directly affect human life through food crops by all these kinds of ripening means. It is urgent to strengthening agricultural soil environment pollution prevention and control, and to improve the rural ecological environment. Adopt legal countermeasures to prevent and control agricultural soil pollution is an important subject which maintains social stability.This paper analyzes the present situation of the rural soil pollution, the cause of pollution, formation of agricultural soil pollution’s impact on the environment and other issues. From the perspective of law, analyze the current situation of the agricultural soil pollution laws and regulations of our country, and analyze and draw lessons from foreign advanced agricultural soil pollution prevention control laws and policies, put forward control countermeasures on the basis of the laws and regulations of the rural soil pollution prevention. Firstly this paper analyzes the concept of agricultural soil pollution, the main sources of agricultural soil pollution and its characteristics impacts, points out the importance and urgency of agricultural soil pollution prevention. Secondly, analyzes the law problems existing in the agricultural soil pollution prevention and control, mainly includes problems like the blank for agricultural soil pollution prevention and control in the field of legislation, law enforcement division of labor is not clear that law enforcement is lax, the pollution information of the public, the judicial relief realistic operating difficulties, and so on. Third, analysis and learn from the developed countries for reference countermeasures of agricultural soil pollution prevention and control law, analyzed the soil contamination countermeasures law in Japan, the United States of the super fund law, and the experience of countries such as Germany. Last but not least, in view of the countryside legal flaws in the field of soil pollution prevention and control, put forward the advices on the perfect our country agricultural soil pollution prevention legislation, strengthen the agricultural law enforcement of environmental pollution, improve the agricultural environmental pollution the judicial relief system, the establishment of rural environmental pollution damages, protect farmers’ environmental right to know, increase penalties.
