The Tang Dynasty, a period of highly developed in politics, economy and culture inancient China, is famous for its highly-open ideology, frequent communication with outsideand summit position in science and art. As for the superstructure in the Tang Dynasty, its legalsystem cannot be gone beyond in feudal society of China. The Tang Dynasty has acomprehensive legal system, which contains law mainly used for adjusting criminal activities,order, style, type and other types of law. The legal system in the Tang Dynasty not onlyovercomes the shortage of miscellaneous and severe laws in the Qing&Han Dynasty, butalso inherits the essence of tolerance and conciseness in the Qing&Han Dynasty and in theWei, Jin and Southern and Northern Dynasty. Its procedural law is well developed andadvanced, especially its Procedure System is extremely mature and standard.This thesis is focused on studying the Procedure System in the Tang Dynasty, trying topractically and realistically analyze Procedure System. The thesis’ mainly structure is asfollows: First, its legislative background and conception will be fully studied. Then, accordingto the combination of studying on laws’ text and interpretation of the specific cases in ancientbooks, the author will give a section discussion about its types, rules, procedures,responsibilities and so on, based on which to draw an outline of the laws in the Tang Dynasty.Procedure System is the product of Chinese ancient feudal society. It is can not be denied thatit has a positive reference influence on the modern legislation of lawsuit system, the judicialpractice and other aspects. Thus, in the last chapter, based on a comparative study andanalysis between the modern lawsuit system in China and Procedure System in the TangDynasty, the author hopes that people can fully absorb the excellent achievements of theancient legal system to perfect the legal system today.
