Research On The Religious Corporation Right Of Personality And Related Legal Suggestions

Religion is a big and sensitive problem in our country even in the world. The research on religion issue and its law right is a theoretic foundation of social law system. Today, personality right movement of the world is booming day by day, Chinese personality’s acquaintance goes deeper and deeper. Today, as the number of Chinese believer of a religion and religion organization expand the public call for freedom of religion belief much eagerer than before. Even though Chinese constitution is explicitly stipulated the principle of freedom of religion belief, the low religion legislation level and the contradiction local code and regulation make unsound religion organization to be the subject of rights and interests infringed. Basic on this background, this thesis analyzes religion corporation personality issue. Through the research of Japan and Taiwan restrict, try to explore religion corporation personality’s concept and its proper situation in modern China legal system.In the first chapter, this thesis introduces the system of religion corporation. Through the analyze from its historical development, legal technical method and legal social police to prove the reason of why religion corporation right can be an independent right.The second chapter dissects what religion corporation right is constituted as a independent right. This chapter explicitly describe religion corporation right’ way of classify, content and characteristic.In the last chapter, the author makes some suggestions in the field of religion law of our country in order to improve religion legal rank, discipline religion institutions and promote religion institutions’development. Finally become the religion freedom clause in the constitution come true.
