Mekong River is a very important trans-boundary water in South Asia region,flowing through six countries, with abundant water resources and organic tourismresources. As nowadays it is of important significance to develop and utilizeMekong River, especia lly in the case of energy shortage, whic h is closelyassociated with energy security and national security. However, in practice, asystematic and effective legal mechanism has not been set up in many countries.According to the analys is of the contradiction and reality, I think it is necessary toset up a law cooperation system. In practice, there are many related conflicts abouttrans-boundary water in the world. One of the relative mature solutions is themodel of how the ten countries in Rhine develop and cooperate about Rhine. Onthe issue of Mekong River, Mekong Protocol in1995is a material that the fourcoastal countries may refer to. In recent years, Mekong River has its ownCooperative Legal Mechanis m, and gradually China is partic ipating in it. TheCooperative Legal Mechanism of internationa l rivers is being further assumed andformed. The theoretical significance of this issue is to perfect the CooperativeLegal Mechanis m in this field, and to provide some relative legal suggestions. Andits practical significance is to solve regiona l disputes and contradict ions, and toprovide legal solutions.Based on the analysis about China partic ipating the development of MekongRiver’s Legal Mechanism, we can discover and discuss many legal issues indeveloping and utilizing international rivers for China from the special to thegeneral, such as the lack in legislation level, the vacancy of protections and thedeficiency of corresponding management departments. According the analys is,China should follow the principle of internationa l laws, such as the princ iple ofesteeming the state sovereignty, of not causing significant harm, of fair andreasonable development and princip le. Based on that attitude, China shouldovercome difficulties and solve the existing proble ms of international law. On onehand, China should make some progress and establis hme nt in internal laws. On theother hand, China should strengthen the communication and cooperation withcountries in Mekong river basin, to reach the protection of legal aspect for awin-win result.
