Study On Trust Legal System Of Intellectual Property

With the further development of global economic integration, the corecompetitive position of intellectual property has become increasingly prominent, andwill gradually replace the real estate and other tangible properties become thedominant social wealth. Point at the status of the unsatisfactory industrial rates ofChina’s intellectual property rights, the author intend to introduce trust system into theindustrial process of intellectual property, it helps relieve the owner of intellectualproperty from the plight of transformation, and draws support from professionalproperty management functions of trust company, efficiently achieves the goal ofintellectual property industrialization, so as to promote the further development ofintellectual property’s strategies in China.First of all, this article starts from introducing the intellectual property legalrelationships, analyzes this kind of trust’s characteristics of subject and object, as wellas the content of rights and obligations. And then make clear the issues of the trustregistration system， such as the effectiveness of registration, the registrationauthorities and the contents of registration. Furthermore, vision into trust company ofthe intellectual property and the trust tax system, and particularly elaborates a trustcompany’s legal status, establish principles and conditions, after comparing the trusttaxation between the Japanese and British, then summarizes the relevant trust taxsystem design experiences. In addition, the article also highlighted the necessity oftrust regulation of intellectual property rights, intends to combine the governmentregulation with the industry regulation, in order to provide double protection for theintellectual property trust. Finally, this article is based on analyzing a wide range ofissues of legal system of the intellectual property trust, proposes to build theintellectual property trust’s supervision system, implement preferential taxation of theintellectual property trust, establish trust registration system of the intellectualproperty, improve the evaluation of intellectual property value chain by learning fromforeign experiences, set up specialized trust company of the intellectual property, and perfect the intellectual property trust’s laws and regulations.
