In recent years, China’s overseas investment begins to enter into an unprecedenteddevelopment rapidly. The “Walking Out” pace of Chinese enterprises is speeding upconstantly. But the political situation of the world is changeable nowadays. The politicalinstabilities of some Countries and districts are increasing so that the political risksamong overseas investment cooperation are increasing, too. Chinese enterprises inoverseas market are suffering serious losses, bringing devastating losses to our country’soverseas investors. During the rapid development of our overseas investment, we shouldkeep calm and clear–headed. We must be pay high attention to prevent political risksduring the oversea investment and enhance the ability towards preventing risks. SoChinese Overseas Investment Insurance System should be established and perfected, topreserve Chinese overseas investors’ legal interest and to promote the development ofChinese economy.This text has discussed the perfection of Chinese Overseas Investment InsuranceSystem from three parts.The first part mainly introduced the concept, characteristics, legislative principlesand significances of Overseas Investment Insurance System.The second part mainly analyzed foreign Overseas Investment Insurance Systemand put forward the enlightenments to China, combining with Chinese specific nationalconditions.The third part mainly analyzed the open questions of Chinese Overseas InvestmentInsurance System.The forth part mainly discussed the physical measures of perfecting ChineseOverseas Investment Insurance System depend on the third part. Firstly, suggested ourcountry’s legislation model: the bilateral model is primary model and the unilateralmodel is complementary. On the basis, put forward the suggestions from domestic lawand international cooperation. As to the domestic law, raise the suggestion of perfecting Chinese Overseas Investment Insurance System from macroscopic and microcosmiclevel. On the macroscopic level, beside the structure of legislation and institution setting,we should make a distinction between developing countries and developed countries.On the microcosmic level, we should modify the fingerpost of Overseas InvestmentInsurance System and formulate Chinese Overseas Investment Insurance System fromnow on. As to the international cooperation, put forward to strengthen the join ofChinese Overseas Investment Insurance System and international treaty, to clear up andannounce international conventions of overseas investment. Meanwhile, we shouldattach importance to the international investment settlement mechanism.
