The Report About The Situation Of Investigation And Handling Of Co Rruption And Bribery Cases In A Primary Procuratorate

Article18of the Code of Criminal Procedure provides that:" Corruptionand bribery,...... are investigated by the People’s Procuratorate."With the rapidand comprehensive development of the social changes, the difficult toinvestigate and deal with corruption and bribery is also increasing.In this case,it is necessary to take some survey and analysis on the previous work, to providea reference and a inspiration for future work.In addition to the introduction and postscript, this paper is divided into sixparts, namely: first, the overall situation of investigation and handling ofcorruption and bribery cases in the procuratorate; second, the analysis andinvestigation of the case sources; third, the investigation of application ofcoercive measures; fourth, the use of investigative techniques and the aspects ofdetective work that can be strengthened; fifth, the length of time of handling thecase investigation; sixth, the investigation and analysis of the prosecution andjudgment. The paper starts from the overall situation and several key aspects ofthe investigation of a district-level procuratorate’s corruption and bribery casesin2006-2011. By investigating the statistical and analytical research, the paperfound out some of the characteristics and regular pattern in the investigation andhandling of the corruption and bribery cases, includes that:1. the chargesfocused on corruption and bribery, but the acts of offering bribes are given moretolerance. Unauthorized possession of state-owned assets, huge unidentified property and other offenses are investigated and dealt with very few or even zeroattention.2. The cases involve government agencies and institutions’“foreigneconomic exchanges field(mainly procurement)”,“”house demolition, landrequisition compensation field”. In addition, the areas of Social Insurance casealso worthy of attention.3. The case that involves a lot of people, and themultiple cases that have contact became the focus of the investigation andhandling, which has obvious effect.4. Own filing ratio needs to be improved,and the procuratorate rather rely on the Commission for Discipline Inspection.Few clues were transferred from the units other than the Commission forDiscipline Inspection.5. In the coercive measures, the application of release onbail has a higher proportion, the changes of the coercive measures are somecommon, and the execution of release on bail is not in place.6. Investigativetechniques can meet the current task, but the innovation and the force is notenough.7. The average duration of handling of cases is4.94months, has beyondthe basic time limit that handles the case, which invert the normal with theexception.8.There is a need to transfer the phenomenon that not fullyprosecution and light punishment.
