The problem of corruption and bribery is an ancient topic, which came into being at the beginning of the class society. After the appearance of the country, the problem of corruption and bribery became a stubborn disease accompanying the ruling class. Therefore, anti-corruption and bribery organizations which correspond with it also arised on the scene. There were corresponding anti-corruption and bribery organizations whether in Qin dynasty, Han dynasty, or Ming dynasty and Qing dynasty. However, these organizations had not eliminated the problem of corruption and bribery completely and the samsara of history had been still unchanged. Falling from favor with the people caused by corruption and bribery is the primary cause of dynasty subrogation. on August 18,1989, the first Anti-Corruption and Bribery Bureau of china was established in Guangdong province. From then on, the Anti-Corruption and Bribery Bureau has passed for 21 years, which was a passionate time.However, since the establishment of the anti-corruption and bribery bureau, the dispute on the focus of whether the procuratorial organs have the power to investigate the duty crime and whether the anti-corruption and bribery bureau should exist in the procuratorial organs has not ceased. As a socialist country, the foundation of our country's constitutional government is different from other countries. Under such a constitutional government of China, which supports popular sovereignty, combining the function of legal supervision and the one of anti-corruption and bribery of procuratorial organs has both the rationality of reality and necessity of constitutional government. The anti-corruption and bribery bureau has played an important role in investigating and dealing with the crime of corruption and bribery. How to respond to the new economic situation and how to play a better role of anti-corruption and bribery department in the new era has become a new subject.Especially with the signing and coming into effect of The UN Anti-corruption Agreement, how to improve the existing anti-corruption and bribery bureau does become the inevitable question. The paper starts with the relationship between the power to investigate the duty crime and procuratorial power. Firstly, the paper elaborates the nature of the power to investigate the duty crime, the necessity and feasibility that procuratorial organs exercise the power to investigate the duty crime, and the constitutional government foundation it rests on.Then it elaborates the establishment of our country's anti-corruption and bribery organizations in the history, the historical experience and influence on our contemporary country. Besides, it illustrates the establishment characteristics and the respective basis of the anti-corruption and bribery organizations in all countries of the world including Hongkong or Macao Special Administrative Region of China. And it also refers to the tentative reform of Anti-Corruption and Bribery Bureau in Chongqing and Yantian. Finally, the paper elaborates the existing problems of anti-corruption and bribery bureau, the bottlenecks restricting the development of it and the reform blueprint proposed through the author's grass-roots work experience.In addition to the introduction and the conclusion, the overall paper includes four parts.The main body has four chapters, approximately 30,000 characters.The first part elaborates the nature, the characteristic and the jurisprudence basis of procuratorial organs' power to investigate the duty crime of our country. It illustrates the necessity and rationality that the procuratorial organs exercise the power to investigate the duty crime by analysizing the nature and the characteristic of procuratorial organs'power to investigate the duty crime of our country. Besides, It illustrates the importance of the anti-corruption and bribery bureau being a part of the procuratorial organs by further discussing its jurisprudence basis.The second part discusses the establishing modes and characteristics of anti-corruption and bribery organizations at home and abroad. The continuation, differences and respective characteristics were found by simply introducing the historic evolution of our country's anti-corruption and bribery organizations and the basic status of foreign anti-corruption and bribery organizations and contrasting foreigners' with our country's contemporary anti-corruption and bribery bureau. The latter part intruduces the basic status of the international anti-corruption and bribery organizations and The UN Anti-corruption Agreement. The third part elaborates the present state and the existing problems of anti-corruption and bribery bureau. By introducing the present state of anti-corruption and bribery bureau and the problems restricting the development as well as finding the problems existing in the anti-corruption and bribery bureau. The paper lays emphasis on the necessity and the urgency of the reform, then it simply introduces the reform and practice of the Anti-Corruption and Bribery Bureau in Chongqing and Yantian.The fourth part is the concept of the future anti-corruption and bribery bureau. The author puts forward the concept of the future anti-corruption and bribery bureau according to the grass-roots work experience and the direction of judicial reform, to further intensify the development of the anti-corruption and bribery bureau and improve the anti-corruption and bribery work of our country.
