On Construction For Judicial Authority Of Our Country

Authority plays an important role in social communication, it is an important part of theauthority, and it is also important for society accepts judicial activities. All Countries payattention to judicial authority in construction of legal system, it has become an importantevaluation standard for the law’s effect. In this paper, I made a comprehensive description forjudicial authority, the specific as follows:The first chapter introduces judicial, authority, judicial authority, the difference betweenjudicial authority and judicial power, and made a more detailed analysis on related concept,laying a solid foundation to later article.The second chapter combines the status quo of our judicial authority, including judicialorgans is relatively weak in the national power structure, the social public mistrust judicial, theimplementation problem of court effective judgment is outstanding, law enforcement by violencedamages the interest of judiciary. These facts prove that judicial authority has not beenestablished in our country, its construction still needs our unremitting efforts.The third chapter mainly analyses the reasons that the judicial authority hasn’t established inour country, mainly caused by constitution, the grading and security administration in internalcourt, cultural and ideological influence and judicial organs itself. Finding deep reasons to set upand improve our judicial authority.The fourth chapter expounds the construction of judicial authority. Mainly includes keepingthe independence of judicial organs, improving the system of court and the judge, preventingjudicial corruption, strengthening the public participation and supervision, reforming the retrialsystem. Through improving these aspects, I believe that China’s judicial authority can be built upgradually.Epilogue summarizes the core viewpoint of this paper, further defined the significance ofestablishing judicial authority and how to construct.
