A Study On Prepaid-consumption Contract Regulation

Pre-paid consumption provides favorable conditions for economic transactions, and also influences on transaction security. Due to a lack of comprehensive and effective legal regulation of pre-paid format contract, pre-paid consumption raises disputes which disrupts financial order, and also violates the consumer’s rights. Being shortage of specific and available legislation, the government often adopts the methods of mediation and coordination to solve the problems, if encountered interests disputes. Based on the general provisions of the law, the principle is not persuasive. Also, this simple approach does not effectively address the substantive issues. Therefore, an urgent need for furthering investigation to the pre-paid consumptive formatted contract which related to the legal issues so as to find out the reasons. Through summarizes the advanced experience of the United States, Japan and EU, this article intends to put forward the proposal of construction about prepaid-consumption contract regulation in order to solve the substantive issues, such as status inequality, object diversity and contract negotiation.
