On Network Crime In Our Country’s Criminal Law

With the rapid development of Internet technology, the use of the network has been deepinto every field of social life, all kinds of network crime also intensified, crack down onInternet crime has become more and more urgent and important. The legal regulating of theour country criminal law about Internet crime has been initially formed on penal code, alongwith special criminal law, administrative regulations, judicial interpretations, administrativeregulations and other normative documents of the framework. Criminal law regulation ofnetwork crime mainly reflects in the criminal law in1997, the National People’s Congress"decision about maintaining Internet security" and "criminal law amendment (7) of therelevant legal provisions. In order to achieve the network of our country of criminal lawregulation of the crime more effectively, this paper first discusses the concept andcharacteristics of network crime, analyzed the new situation, the classification of networkcrime, examines the existing laws in China about Internet crime legislation and deficiency. Onthis basis, the crime of criminal jurisdiction, the design of the network, such crimes,constitutive requirements, configuration, and network crime punishment of accomplice thatpresents theory so as to further clear and perfect.
