Research On The Criminal Law Regulation Of Cyber Society

In the 21 st century, with the transformation and development of network function, cyber society gradually formed. We must face the frequent, multiple, and new crime problems of cyber society. Based on the works of collating our country criminal law about cyber crime legislation criminal legislative circumstances and problems, and investigating the extraterritorial legislation of cyber crime, the thesis tries to put forward the suggestion of criminal law to control the cyber society in our country.First of all, the overview part of this thesis mainly elaborates the academic and practical significance and makes a research of our country and abroad, and then clear research method. The second part Introduces the network function transformation to gradually form a "cyber society" similar to the real society. There is the characteristics of the reality social of "reality" and unique virtual in cyber society.The third part is divided into two sections: the first section is about China's mainland criminal legislation of “Computer network crime”, and the second section is to found the insufficient of current criminal law about dealing with cyber crime.In the fourth part, this thesis mainly summarizes network development and the current situation of criminal legislation of the United States, Japan, the Taiwan region, In order to discover problems and sparkle.This thesis try to make suggestions to improve our country criminal law of cyber society.In the last part is summary, and the author express position and viewpoints of this thesis and discussed the significance and prospects of this research.
