Reflections On China’s Radio Legislation

In the information age, the radio has entered into people’s life and production, it becomes an important part of economic construction, social development and national defense construction. People can not do anything without radio applications, because radio waves between people form a variety of rights and obligations, so it needs legal norms to adjust. Although China has formed a legal system with "radio radio management regulations" as the main content,still relatively fragmented, many contents which involving frequency management exist other same effective or even inefficient force level of special laws, and the legislation content deletion and20years without amendment resulted in the contents of the old problems are also very prominent. For example,the first,content is not perfect. The second,the low rank of legal effection.The third,the process has lagged behind.And content is not perfect mainly represents in three aspects:the main content of legal principles; management system is not smooth; spectrum resource ownership is not clear; the lack of security system, the unknowned legal responsibilities. I have put forward the legislative proposals. The main contents include, one is clearly the purpose of legislation, establishing the basic principles, including establishing strategic thinking and development, the use of economic instruments to promote development, establish economical, ecological, social benefits according to the principle of combining the development; two is to perfect legal system, definite the legal responsibility, in the system of Department of administrative management system, frequency management system (station), station management system, security system for serious research, put forward the suggest and countermeasures to perfect the system, clear and definite the legal responsibility including clear responsibilities, increase offender accountability efforts, and make radio punishment discretion benchmark; three is to enhance the level of law, accelerating the progress of legislation, the main is to expand the social influence, to promote the level of legislation.
