The Legal System Of China's Notary

As the politics, economy, legislation and culture of China develop rapidly, the notarization becomes more and more important in the political and economic fields of the society at the present. The current era endows Chinese notaries with the dignified mission of promoting harmonious development of economy, safeguarding fairness and justice of society and structuring credit system of society. However, Notarization Law and relevant regulations of our country are far more lagged. There is no specific regulation about the nature and position of notaries. This makes the responsibility, power and benefit of Chinese notaries unbalanced, and makes notaries be exposed to lots of practice risks.The paper takes the origin of notary system as the entry point. Starting with the introduction to the concept of notaries and notary system, it gives a brief introduction to the contents about notaries and notary system in notarial legal system of China and foreign countries through discussing the origin and development of notarial legal system of China and foreign countries. After that, the paper uses the comparative analysis method to elaborate the relevant regulations about the legal system of notaries of our country, expound the origin, changes and current situation of the legal system of notaries of our country and discuss the questions about legal nature and legal position of notaries. And then, it uses the case analysis method to elaborate some realistic questions in the legal system of notaries of our country, including obscure determination on nature, deficiency of law making, current situation of team and risks of practice, and carries out the qualitative analysis to comb and standardize the systems and discusses the future development trend of legal system of notaries in our country and the realistic questions which need to solve. At last, aiming at the existing questions, the paper brings forward the lawmaking suggestions for standardizing and improving the legal system of notaries of our country, mainly including improving the legal system, clarifying the legal position, enhancing the team construction, improving the practice guarantee system and so on.
