Study On Community Oligarchs Governance Model With Homeowner Collective Action Perspective

Formerly, study of homeowner committee concentrated on rights protection and governance of community. The study of rights protection focused on the mobilization and action strategy, but there is a tendency that this study considered that collective resistance is homeowner action.And the study of community governance focused on the community organizations’ cooperation, but over emphasized the theory. Both of these studies ignored putting homeowner committee into the study of community governance.Through lots of cases, neighborhood committee and property management company are main governing subjects in today’s community. Although homeowner committee is the tutelary administration of property management company in the legal sense, homeowner committee is almost useless in reality, except a few communities that realize proprietor auto-management. But these communities’ governance model is oligarchs governance. This essay is trying to solve this question. Through the multiple-case study of homeowner committee, this essay considers that homeowner committee is useless because of the internal pressure and external pressure. And dormant homeowner committee must be activated by rights protection action which is lead by accidental event. The activist is the key. In the control of strong external pressure, after right protection, the community governance has three results:first, the homeowner committee will be paralyzed; second, homeowner committee will be back to dormant; third, homeowner committee will be the principal part of community governance which will lead to the oligarchs governance. In this process, the decisive factor is the elite who has public spirit, intentions, ability, resource and perseverance. Although oligarchs governance realize the owner self-ruling, it also has some potential risk, that is the non-democracy.
