Fanquan is a popular promotional tool and pricing strategy in all kinds of shopping malls, especially the large shopping malls. From birth, this kind of promotion way showed flourishingly vitality,and gave the operator to bring rich and generous profit.But due to China’s imperfect legal systemthe and lack of consumer awareness of the public, the business more and more frequent abuse of such promotions Below interest drive. On one hand, This behavior infringes the lawful rights and interests of consumers, such as operators using false propaganda, price fraud and unfair clause means enroach on consumer’s right to know, the right choice and even bargain rights.on the other hand, This behavior destroyed the fair competition order, reduce the other operators legitimate trading opportunities, If severe enough, this behavior may lead to vicious competition in the industry, which is not conducive to the healthy development of the whole industry. Therefore, our country strengthens pair of promotional coupons legal regulation is inevitable and urgent. China’s existing laws and regulations related to this regulation is the comparison principle and simple, the lack of operability. On the basis of the overseas related legislation, the relevant departments should establish "accord with national condition" legislative policy and legislation mode, and improve related laws and regulations, such as perfecting the operator’s obligation to inform, three packets of obligation, introducing punishment compensation principle in the legal responsibility, and set about promotions in the unique issues of the legal system.
