Reconstruction Of The Limit Compensation System Of Railway Traffic Accident

In our country’s transportation industry,railway transportation is the most important form of transportation in cargo operation and passengers’travel. The development of national economy and the stability of social order are closely related to railway transportation. At the same time, the problems that are related with railway transportation get high attentions. One of them is the limit compensation about passengers’personal injury in railway traffic accidents. From a variety of different opinions about compensations in "7.23" CRH’s rear-end collision in2011to the abolition of the legal basis on limit compensation in railway transportation on January1,2013, it has caught concerns and discussions in jurisprudential circle upon one system about limit compensation in railway passengers’transport damages.This paper consists of3parts. Section one introduces the serious railway traffic accidents and opinions on the compensation in "7.23" CRH’s rear-end collision. Section two introduces the limit compensation system of railway traffic accidents and the legal and practical basis, moreover, compares the legislation at home and abroad. Section three combines with the second part of the basis of reason paper, puts forward the reconstruction of railway limit compensation system,and frome gislation, limit compensation, compensation standards, several limitations of insurance system to carry on the concrete description, in order to perfect our railway traffic accident compensation system, promote railway transportation industry healthy and harmonious development in our country.
