Industrialization brought the great rich of the material wealth, but also planted alarge number of environmental concerns. Environmental issues of China has becomeone of the most prominent, more and more serious pollution and destruction wasappeared and caused a great threat to the development of socio-economic, people’slives and property safety. In early2013, Beijing and other places was suffered aserious invasion of fog and haze, the first orange alert of Beijing was released. Andthis is just the tip of the iceberg, environmental emergencies were not only quantity,but also increasingly complex. The great challenges were brought to deal with. Inrecent years, environmental protection efforts was increased in China, environmentalprotection laws and regulations was also improved; But in the face of complex andvolatile form, the legal system lag obvious manifestation, inadequate publicparticipation lack of supplies, personnel security deficiencies in the system havebecome the soft underbelly of the impact of environmental emergencies to deal withthis urgent need to speed up the construction of legal systems to adapt to new types ofenvironmental emergencies response. Analyzed with the three aspects of the respondto environmental emergencies, it proposed some suggestions to solve these problemsin this paper.The article is divided into five parts: Chapter I, introduction. In Chapter II, theauthor had introduced the overview of environmental emergency legal system. Theconcept of environmental emergencies was defined in this chapter; then, the reasonsand the harm were classified and analyzed; the emergence and development of thelegal system were responded to environmental emergencies, and the need for itsexistence was further analyzed. In Chapter III, the author had introduced the foreignenvironmental emergencies legal system and the enlightenment to China. The featuresof the legal system of the United States, Russia, Japan and Germany and othercountries were first introduced in this chapter, such as Germany pass legislation toestablish volunteer service system, the United States Federal Response Plan; then theexperience of national characteristics was summed up, such as adhere specifically, theharmonization of legislation, improve the management system, and legislation to protect citizens’ right to know; finally draw some inspiration. In Chapter IV, the authorhad analyzed the status quo and problems of China’s environmental emergency legalsystem. In Chapter V, the author proposed recommendations to improve ourenvironmental emergency legal system. three phases of response to environmentalemergencies were generally started in these chapters, the fourth chapter focuses oncontingency plans, crisis drills, public participation, information disclosure,accountability, assessment, management and other aspects concentrate on the legalsystem current situation and existing problems; On this basis, recommendations of thelegal system was proposed in the fifth chapter, such as standardized informationreporting system, protection of full public participation and improvement of the legalconsequences system and legal relief system.
