The Perspective Of People’s Jury System Under The Judicial Credibility

People’s jury system has experienced more than half a century, it’s development hasexperienced twists and turns. After the21st century, it has been a hot issue in the field ofjudicial reform, different people analyzed the jury system from different angles, but thejury system’s function of molding and improving the judicial credibility is ignored.With the increasing of petitioners, the phenomenon of judicial corruption emerges inendlessly, especially in recent years, cases caused by the unreasonable judicial refereeoccur frequently, making the social public more and more mistrust the judicial activities,one path to solve this problem is to make people’s representatives participate in the trial,using the supervision power of the masses to make people agree with justice, so as toachieve the effect that the judicial absorb and dredge public opinion, to reach theinteraction state between the people and the judicial system, which is the efficient way toenhance judicial credibility from the external, the jury system just merged the concepts ofthe judicial democracy and the judicial justice. So in this paper, based on the research ofjudicial credibility, through combing the history of the people’s jury system to explore theconnotation of obtaining the public trust and enhancing the judicial credibility, andsearching the equilibrium point between the judicial credibility and the jury system, whohas the basic value and the basic function of judicial democracy and judicial justice.Combining related survey and empirical data provided by the dialysis to dialyze that thestatus of the people’s jury system "reality" how to apply to the judicial credibility, andrespectively compare the influence of Chinese and western jury system to judicialcredibility, hope to review the people’s jury system in the perspective of judicial credibility,and put forward practical suggestions, in order to reconstruct people’s jury system, andabsorb the rational public opinion into the judiciary, and enhance the judicial credibility.This paper consists of four parts.The first part introduces the basic theory of the jury system and judicial credibility,this is the starting point of the full text research and discussion discourse presupposition,make a solid foundation for the back systemic research.The second part is the internal connection of jury system and the judicial credibility, itis the precondition for the subsequent system discussion, respectively discusses from thejudicial credibility origin of the jury system, the internal mechanism of jury systemenhancing the judicial credibility, in order to build theoretical framework for later study.The third part is to analyze the people’s jury system function of the judicial credibility,state the development history of the people’s jury and the embodiment of judicialcredibility, and analyze the situation of people’s jury system through empirical analysismethod, summarizes the obstacles of shaping judicial credibility.The fourth part puts forward constructive suggestions for reconstructing the newpeople’s jury system enhance the judicial credibility on the basis of the foregoing analysis and the difficulties existing in the jury system in our country study clarified, respectivelyput forward suggestions from the reform of the text and the system.
