Study On Criminal Reconciliation Of Public Prosecution In China

Criminal reconciliation is peaceful and restorative, its legal effect and social effect is more positive than traditional style. Therefore, the criminal reconciliation is popular worldwidely. Criminal reconciliation in China is based on the background of building a harmonious society and the criminal policy of tempering justice with mercy. In recent years, China local judicial organs explore actively on criminal reconciliation and have obtained positive effects. Criminal reconciliation can resolve the contradiction between criminal and the victim effectively, restore the damaged social relations, make more harmonious interpersonal relationships in certain area. But in practice and theory, Criminal reconciliation is always in discussion. Criminal reconciliation has been ruled in the revised criminal procedure law. However, there are still many problems to be solved.This paper simply analyses the theoretical base, practical significance of criminal reconciliation of public prosecution. Second, the paper discusses the applicable principles, scope, conditions, way, result of criminal reconciliation of public prosecution and put forward the writer’s opinion. Third, the paper discusses the practical application in different judicial stages including the investigation stage, review and prosecution stage and trial stage. Last, put forward suggestions to refine the system.
