The People’s Supervisor System Research

The people’s supervisor system is a new type of social supervision system, which is based on the constitutional principles of the rule of law and democracy, and exercise discretion of the procedural supervision over criminal cases in the legal supervision by authority agencies according to certain norms and procedures, in order to regulate duty crimes indictment, the investigation power, prosecution power, to ensure the orderly, fair and honest, maintaining fairness and justice. The people’s supervisor system as the supreme people’s procuratorate’s innovation system has showed certain effects since running. However, due to the lack of clear legal provisions and the shortcomings of the system design, the system won’t take a deep development. To be specific, the supervisor people elected and supervision range are not scientific; the independence of the people’s supervisor status is not strong; the rights and obligations of the people’s supervisor to perform are unclear. In order to deepen the reform of the people’s supervisor system, it shall reasonably determine the selection range of the people’s supervisor and establish the selection procedures of the people’s supervisor; expand the scope of supervision; improve the program specification of the people’s supervisor system; strengthen the people’s supervisor rights and obligations and improve the credibility of the people’s supervisor system.
